EEOC Update: Commission Votes to Postpone Action on ADAAA Regulations
AAPD staff attended the meeting of the Equal Employment Opportunity Commission yesterday that was scheduled to discuss new regulations implementing the Americans with Disabilities Act Amendments Act. EEOC Chair Naomi Churchill Earp, citing concerns that had been raised by members of the disability community about the Commision issuing an “Interim Final Rule” that would take effect without any opportunity for our community to review and comment on them, announced yesterday that she had decided to follow a more traditional “Notice of Proposed Rulemaking” process where we would have an opportunity to comment on the proposed regulations before they take effect.
The Commission then discussed whether the proposed regulations were ready to be circulated for comment, and two of the four Commissioners (Stuart Ishimaru and Christine Griffin) said that they believe the proposed regulations need more work and voted against issuing them as a proposed rule at this time. Thanks go to JFA subscribers for weighing in with the Chair and the Office of Legal Counsel expressing your concerns about the EEOC issuing an Interim Final Rule before our community sees it. Your advocacy had an impact, and there will now be an opportunity for the Commission to produce regulations that have the same kind of bipartisan support that the law itself had.
I don't want the EEOC to rush regulations through and I don't want the regulations to take years to finalize. I also don't want the regulations to be written and not followed and the courts not hold ALL employers accountable--government agencies included.
My 8 1/2 years of representing myself pro se using the worthless 29 C.F.R 1614 regulations for my complaint process because I was hired into a non-existant 1614.102 agency program, gave me an education. The words in the regulations and management directive are not the problem in a lot of situations. How the intent of the regulations and directives are twisted and ignored by our justice system is the main problem.
The regulations need to be written so they cannot be twisted or ignored by ANY employer and ALL disabled employees have the same rights.

the best thing for obama to do is to fund personal assistance at home and on the job for disabled who are not medicaid eligible. there are many neurologically disabled who have motor, mobility and coordination problems and cannot use a device for mobility and need arm assistance of another to get around, work etc and also need assistance with motor tasks and also at home need someone to cook and do laundry. these services are either not there or very expensive and people have to rely on friends and family who also work and have other responsibilities. please address this urgent issue.
